Terms of Service

These terms govern your access to and use of Tonic. Please read them carefully — by using the Services you agree to them.

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Tonic App Ltd ("Tonic", "we", "us") and govern your access to and use of the Tonic iOS app and the tonicapp.co website (together, the "Services").

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Who can use Tonic

You may use the Services only if you can form a binding contract with us and are legally permitted to do so.

  • You must be at least 16 years old, or the minimum age of digital consent in your country if higher.
  • You must provide accurate information and keep it up to date.
  • To help keep Tonic free of bots and bad actors, we may ask you to complete a one-time identity check through our verification provider before accessing certain features.
  • You must not use the Services if you are barred from doing so under applicable law or have previously been removed for violating these Terms.

3. Your account

You sign in with Sign in with Apple. You are responsible for the activity that happens on your account and for keeping access to your device and Apple ID secure. Notify us promptly at hello@tonicapp.co if you believe your account has been compromised.

You may enable a biometric (Face ID) lock to add a layer of protection to your content. You may not share your account, sell it, or let others use it.

4. Community rules and acceptable use

Tonic is a space for people navigating heartbreak and recovery. To keep it safe and supportive, you agree not to:

  • Harass, bully, threaten, dox, stalk, or incite violence against anyone.
  • Post hateful, discriminatory, sexually exploitative, or otherwise harmful content, or content that sexualises minors.
  • Encourage or glorify self-harm, suicide, eating disorders, or substance abuse.
  • Share content that is illegal, infringes others' rights, or violates anyone's privacy.
  • Impersonate others, create fake accounts, or misrepresent your identity or affiliation.
  • Spam, scam, phish, distribute malware, or attempt to disrupt or gain unauthorised access to the Services.
  • Scrape, harvest, or collect data about other users, or use the Services to build a competing product.

We may remove content, limit visibility, or suspend or terminate accounts that violate these rules. We may also report unlawful activity to the authorities.

5. Your content

You retain ownership of the content you create — your posts, diary entries, comments, photos, and video ("Your Content"). You are responsible for Your Content and for having the rights to share it.

You grant Tonic a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), and distribute Your Content solely to operate, provide, and improve the Services. For content you choose to make public, this licence extends to displaying it to other users as you direct. This licence ends when you delete Your Content or your account, except for copies retained in routine backups for a limited period or where retention is legally required, and for content others have already shared or saved.

6. Content from other users

The Services contain content created by other users. We do not endorse and are not responsible for user content, and you use and rely on it at your own risk. If you see content that breaks our rules, please use the in-app reporting and safety tools so we can review it.

7. Not medical or crisis advice

Tonic supports emotional wellbeing and recovery but is not a medical device and does not provide medical, psychological, or professional advice. Content on the Services — including any wellness or fitness data — is for general informational and personal-reflection purposes only and is not a substitute for professional care.

If you are in crisis or think you may have a medical or mental-health emergency, contact your local emergency services or a qualified professional immediately. Do not rely on the Services for urgent help.

8. Third-party integrations and data

You may optionally connect third-party services such as Apple HealthKit, WHOOP, Strava, and Oura. Your use of those services is governed by their own terms and privacy policies, and you are responsible for your accounts with them. We are not responsible for third-party services, and they may change or stop providing data to us at any time. You can disconnect an integration at any time.

10. Our intellectual property

The Services, including the Tonic name, logo, design, software, and content we provide (excluding Your Content and third-party content), are owned by Tonic App Ltd or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Services as intended. You may not copy, modify, reverse engineer, or create derivative works from the Services except as permitted by law.

11. Feedback

If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or obligation to you.

12. Suspension and termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Services or other users. On termination, the rights granted to you under these Terms end, while sections that by their nature should survive — such as content licences already granted to others, disclaimers, and limitations of liability — will continue to apply.

13. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content is accurate. Nothing in these Terms excludes or limits any rights you have under applicable consumer-protection law.

14. Limitation of liability

To the fullest extent permitted by law, Tonic App Ltd and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or GBP 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and nothing here limits liability that cannot be limited by law.

15. Indemnification

You agree to indemnify and hold harmless Tonic App Ltd from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your violation of these Terms or of any law or third-party right.

16. Changes to the Services and these Terms

We may update the Services and these Terms from time to time. When we make material changes to these Terms, we will update the date above and, where appropriate, notify you in the app or by email. Changes take effect when posted, and your continued use of the Services means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over any dispute, except where mandatory local law gives you the right to bring proceedings in your country of residence. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
